AGB – General Terms and Conditions Studio Berlin
The stated prices for the studio rent, as well as telephone, electricity and other consumption-related services will be invoiced after the rental period has expired. The respectively valid rental prices can be viewed at www.studioberlin.eu. All prices are net prices plus the legally applicable value added tax.
Agreed test prices are subject to the General Terms and Conditions of the Studio Berlin and further additional terms and conditions, which the renter requests, sees, countersigns for approval and sends back to the Studio Berlin before the beginning of the rental period.
The rental becomes legally effective with the mutual signing of the rental contract. Offers and cost estimates, as well as a date reservation, are always non-binding and do not justify any claim to the conclusion of a rental contract. In this context, the Lessor is not liable for the fact that the use intended by the Lessee is feasible under actual or legal conditions.
The rental indicated in the price list is a daily rental and includes a maximum rental period from 8 am to 6 pm or from 9 to 7pm. In addition, an overtime surcharge of 15% of the agreed daily rent per hour is charged. Billing is based on full days.
The invoice is payable within 21 days of the invoice date. New customers must pay a deposit of 50% of the total net amount before renting the studio.
Equipment, catering, drinks and other services such as set construction, painting or assistance are not included in the studio rent and will be charged separately. The Studio Berlin reserves the right to charge a handling fee of 15% for services provided by third parties. Agreements deviating from the price list must be confirmed in writing.
Cancellation costs: The tenant can withdraw from the contract up to one week before the agreed start of the rental period free of charge. From the time of one week to the time of exactly 48 hours before the start of the rental period, cancellation costs of 50% of the agreed rent are to be paid. From the time of less than exactly 48 hours before the start of the rental period but more than 24 hours before the start of the rental period, 75% of the agreed rent are to be paid. After the latter point in time, the full rent minus saved expenses of the lessor is to be paid. As far as a further renting out is possible, the cancellation costs are omitted according to the amount of the otherwise collected rent.
The tenant undertakes to treat the rooms and furnishings with care and attention. The tenant is liable for all damage caused by him, his employees or other persons to whom the tenant grants access. The Lessee may only use the rented rooms for the contractually agreed purpose and may only allow third parties to use them with the written prior consent of the Lessor. The Lessor shall be notified immediately of any damage incurred.
If the studioberlin is rented to a third party, the internet connection of studioberlin is included. Should a copyright infringement take place via the studioberlin internet connection, e.g. protected works are downloaded by team members, this is illegal as illegal public access according to § 19a UrhG. Any damages incurred (claim for damages according to § 97 Abs. 2 UrhG) shall be borne by the respective Studio Berlin renter(s).
It is the responsibility of the lessee to obtain any official permits required for the purpose of the rental, to ensure compliance with accident prevention regulations and to take out all necessary insurance policies.
The Lessor does not guarantee that the rooms are suitable for the purposes of the Lessee and that they comply with the statutory provisions prescribed for these purposes.
Shooting or recording in the courtyard of Lützowstr.102 - 104, 10785 Berlin, only with prior permission of the owner. Please contact the studio management in this regard.
Catering vans may only park in the Lützowstrasse. Please register at Studio Berlin before shooting, if the courtyard is required. Extraordinary permission is also required here.
No live music may be played in the Studio Berlin between 7 am and 7 pm.
In case of incorrect information from the customer regarding the choice between Editorial Shooting and Commercial, or photo & film, the Provider is entitled to charge the customer for the services in question - in deviation from the offer - when the invoice is issued.
Place of jurisdiction is Berlin.
